Terms of service

1. Who can use NowOpen.ai

NowOpen.ai is for businesses, including sole traders and freelancers. You may use it only for your business or one you are allowed to act for, not as a consumer. If you accept these terms for a business, you confirm you are allowed to bind it. Accounts are invite-only for now, one per invitation, and each account can have up to three sites.

2. The service

We build websites from what you tell us, with AI, host them, and let you change them by asking. You can give each site an address on our domain or connect a domain you own.

AI makes mistakes. Check every version before you publish it: you are responsible for what your published site says, including prices, opening hours and contact details.

We work to keep NowOpen.ai available but do not guarantee that it will be uninterrupted or free of errors. We may change, add or remove features. If we stop offering the service altogether, we will tell you by email at least 30 days in advance.

3. Price

Your first year is free, counted from the day you create your account. After that, NowOpen.ai costs €29 per year, excluding VAT. Before your free year ends we will email you to ask whether you want to continue, and we never charge you without your agreement. If you choose not to continue, we will tell you by email at least 30 days before your sites stop being served.

Your account includes an AI budget, shown on your list of sites, which every build and edit uses. When it runs out, you can no longer build or edit with AI, but you can still view, publish and restore versions and connect domains.

4. Your content

You keep all rights to what you give us: your text, files, images and the content of your own website. You allow us to store, copy, process and publish it, and to send it to the providers named in our privacy policy, only as far as we need to run the service for you. This permission ends when you delete the content or the site it belongs to.

The sites we build for you are yours to use as you like. Our software, design system and everything else that makes up the service remain ours.

You confirm that you have the right to use everything you give us or ask us to read. When you point us at another website for its look, we follow its layout and style, not its words or pictures; do not ask us to copy someone else’s content.

5. What you may not do

You may not use NowOpen.ai to publish or do anything that:

• is illegal, or infringes anyone’s copyright, trademark or other rights;
• deceives people, such as phishing, impersonating another business or fake reviews;
• spreads malware or attacks other systems, including ours;
• is hateful, harassing, or sexually explicit;
• sends spam, or collects visitors’ data without a legal basis to do so.

You may not try to get around the AI budget, the site limit or our security, or resell the service without our written permission.

6. Your visitors and your domain

You are responsible towards the visitors of your sites, including any third-party tools you add to them, such as a booking widget. For your visitors’ personal data you are the controller, and we process it only on your behalf, to host your site.

A domain you connect stays registered in your name with your registrar, and keeping it renewed is up to you. An address on our domain is yours to use while the site exists; when the site is deleted, the address may be given to someone else.

7. Suspension and ending

You can delete a site at any time from your list of sites, which removes it and everything about it for good. To close your account, email gautier.fauchart@gmail.com.

We may unpublish a site or suspend an account that breaks these terms. Where we can, we will tell you first and give you a chance to put it right; for illegal content or a risk to others we may act at once. When your account ends, we delete your sites and their data as our privacy policy describes.

8. Liability

Our total liability to you, for everything related to NowOpen.ai, is limited to the greater of what you paid us in the 12 months before the event and €100. We are not liable for indirect loss, such as lost profit, lost revenue or lost data, or for what you or the AI publish on your site after you have been able to check it.

These limits do not apply to damage caused by our intent or deliberate recklessness, or where the law does not allow liability to be limited.

If someone makes a claim against us because of your content or your use of NowOpen.ai in breach of these terms, you will cover our reasonable costs of dealing with it.

9. Changes to these terms

We may change these terms. We will email you at least 30 days before a change that affects you takes effect. If you do not agree with it, you can close your account before then; continuing to use NowOpen.ai afterwards means you accept the new terms.

10. Law and disputes

Dutch law applies to these terms. Disputes go to the competent court in the Netherlands, but please write to gautier.fauchart@gmail.com first: most things are faster to settle by email.
